1. Agreement to Terms

By using ZapDM, you represent that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into this agreement. If you are using the Service on behalf of a company, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

ZapDM provides an AI-powered automation layer for Instagram Direct Messages. Our service facilitates automated responses to comments and DMs based on user-defined triggers and AI logic. ZapDM is NOT affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. or Instagram.

3. Platform Compliance & Account Safety

You agree NOT to use ZapDM for:

• Sending spam, unsolicited marketing, or deceptive content.
• Harassment, bullying, or spreading hate speech.
• Violating Instagram’s rate limits or technical restrictions.
• Impersonating individuals or entities without authorization.

ZapDM is not liable for any account restrictions, temporary bans, or permanent suspensions imposed by Meta/Instagram resulting from your use of the Service.

4. ZapAI and AI Limitations

Our "ZapAI" features utilize third-party Large Language Models (LLMs) like OpenAI’s GPT models. By using these features, you acknowledge:

• 01.AI can "hallucinate" or provide incorrect information. You must review and supervise AI-generated responses.
• 02.ZapDM is not responsible for any misinformation, offense, or business loss caused by AI-generated content.
• 03.AI usage is subject to fair use limits and specific plan quotas (Ions).

5. Plans and Usage Limits

Each ZapDM plan (e.g., Spark, Bolt, Lightning, Zeus) comes with specific usage quotas:

• Auto DMs: The number of automated messages you can send per month.
• ZapAI Conversations (Ions): Counted per 24-hour session or 20 messages.
• Connected Accounts: The maximum number of Instagram profiles you can link.

Usage is reset at the beginning of each billing cycle. Unused quotas do not roll over to the next month.

6. Payments, Subscriptions & Refunds

ZapDM offers various subscription tiers and occasional Lifetime Deals (LTDs).

• Auto-Renewal: Subscriptions renew automatically unless canceled at least 24 hours before the period ends.
• Pricing: We reserve the right to change pricing with 30 days' notice.
• Refunds: We offer a 7-day "no-questions-asked" refund policy for first-time monthly/annual subscribers. Lifetime Deals (LTDs) are generally non-refundable unless specified otherwise during the launch campaign.

7. Intellectual Property

The ZapDM platform, including its software, designs, logos, and branding, is the exclusive property of ZapDM. We grant you a limited, non-transferable license to use the Service during your subscription period.

8. Termination

We reserve the right to suspend or terminate your account immediately, without notice, for breaches of these Terms, suspected fraudulent activity, or if required by law or Meta API policies.

9. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Udaipur, Rajasthan, India.
